Terms and conditions

Article 1. Applicability
1.1 These General Terms and Conditions apply to all offers, orders, and agreements of GVINTY studio.

1.2 By accepting an offer or placing an order, you agree to these General Terms and Conditions.

1.3 Deviations from the provisions in these Conditions are only valid in writing, whereby the remaining provisions remain in full force.

1.4 All rights and claims stipulated in these Conditions and any additional agreements for GVINTY studio. also apply to intermediaries and other parties engaged by GVINTY studio.

Article 2. Offers & agreements
2.1 An agreement is only concluded when GVINTY studio. accepts your order. GVINTY studio. reserves the right to refuse orders or to attach specific conditions to the delivery, unless otherwise stated. If your order is not accepted, you will receive a message from GVINTY studio. within five business days of receiving the order.

Article 3. Prices & payments
3.1 The prices for our products and services are in euros, with VAT on second-hand items. Import duties are at the consumer's expense.

3.2 You can pay via iDEAL, credit card, or bank transfer. For payment by bank or giro, the date on which the amount is credited to GVINTY studio.'s account is considered the date of payment.

3.3 GVINTY studio. reserves the right to cancel the order if the payment term is exceeded.

Article 4. Shipments, deliveries & returns
4.1 We ship worldwide. Shipping within the Netherlands costs € 10,- and is fully insured. Shipping to European countries costs € 20,- and is fully insured. Shipping outside Europe costs € 30,- and is fully insured.

4.2 We ship all our items fully insured via DHL. After receiving payment, we will send your item within 24 to 48 hours.

4.3 Shipping within Europe takes approximately 2-5 business days, while shipping outside Europe takes approximately 5-10 business days. Please note that we are not responsible for delivery time.

4.4 After shipment, you will receive a tracking number to track your item. Import duties, taxes, or other import costs are at your expense and are not the responsibility of GVINTY studio. Always check the import duties of your country outside the EU.

4.5 If the item you ordered is out of stock, we will contact you on the same day. Orders placed on weekends will be shipped on Monday.

Article 5. Retention of Title
5.1 Ownership of the delivered products will only transfer to you once you have fully met all your payment obligations to GVINTY studio., as stated in any agreement. However, the risk of the products transfers to you at the time of delivery.

Article 6. Intellectual & industrial property rights
6.1 You must fully and unconditionally respect all intellectual and industrial property rights resting on the products of GVINTY studio.

6.2 GVINTY studio. cannot guarantee that the products delivered to you do not infringe existing or future intellectual and/or industrial property rights of third parties.

Article 8. Authenticity Guarantee
8.1 GVINTY studio. guarantees that the delivered products meet the usual requirements and standards and are free from defects.

8.2 Do you doubt the authenticity of an item from GVINTY studio.? Please contact us. We will have the item authenticated by a third party. The costs for this are at your expense. You can, of course, also do this yourself.

Article 9. Force Majeure
9.1 Notwithstanding your future rights, in the event of force majeure, GVINTY studio. may, at its discretion, suspend the execution of your order or dissolve the agreement without judicial intervention. GVINTY studio. will inform you in writing of such a decision and is not liable for any damages, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.

9.2 Force majeure is defined as any shortcoming that cannot be attributed to GVINTY studio. because it is not due to its fault and does not fall under the law, legal act, or applicable rules at its expense.

Article 10. Miscellaneous
10.1 If you provide GVINTY studio. with an address in writing, GVINTY studio. will send all your orders there. If you want your orders to be sent to a different address, you must notify GVINTY studio. in writing in advance.

10.2 If GVINTY studio. allows deviations from these Conditions for a certain period, silently or not, this does not affect its right to demand immediate and strict compliance. You cannot assert any rights based on GVINTY studio.'s lenient application of these Conditions.

10.3 GVINTY studio. is authorized to engage third parties for the execution of your order(s).

Article 11. Applicable law & competent court
11.1 These Conditions apply to all rights, obligations, offers, orders, and agreements. Dutch law exclusively applies to all these matters, as well as to the Conditions themselves.

11.2 All disputes between parties will be exclusively handled by the competent court in the Netherlands.

Article 12. Copyright
12.1 The copying of prints or entire parts of the text of downloaded documents is strictly prohibited by the copyright on all images or parts of images available on this website without the express permission of the author.
